Mark W Smith

Visiting Fellow in Pharmaceutical Public Policy and Law

Professor Mark W Smith is a Presidential Scholar and a Senior Fellow in Law and Public Policy at The King’s College in New York City.  Professor Smith was previously an adjunct professor of law at the University of Kansas School of Law. He is a former editor of the New York University Environmental Law Journal.

 Professor Smith has advised institutions, companies and individuals on “legal landmines,” i.e., activities that might lead to costly disputes or legal liability.  His current research at Oxford involves identifying legal landmines at scientific and medical departments at the world’s leading universities and scientific institutes.  Professor Smith’s academic research on legal landmines includes a focus on known and unknown risks in scientific, academic and commercial settings with an emphasis on the growing scope of legal, regulatory, political and reputational liability risks for entities and individuals.  He seeks to develop best practices for scientists, researchers and medical professionals, and to combine relevant practical concerns with more theoretical legal and ethical considerations.

 Professor Smith has lectured and presented widely in academic and scholarly settings, and has spoken at the Harvard Law School, Princeton University, Columbia Law School, and the Wharton Business School (MBA) at the University of Pennsylvania.  His work has been published in the Harvard Journal of Law & Public Policy, the Oklahoma Law Review, Arizona State University’s Corporate and Business Journal, and the Seton Hall Legislative Journal.  Professor Smith has recently had articles accepted for publication by the Catholic University Law Review and the Texas Tech Law Review.  Professor Smith is also a New York Times bestselling author who has authored six books.

Professor Smith is a recognised public policy expert, and his opinions are sought after by a broad range of media outlets.  Policy Experts: Insider Guide to Public Policy Experts and Organisations and the Journalist Guide to Legal Policy Experts list Professor Smith as a public policy expert on legal subjects.  Professor Smith’s efforts in the courtroom have been featured on the cover page of The New York Times and his legal work has been reported throughout the United States.  Professor Smith has appeared as an expert legal analyst on CNN, Bloomberg Television, CourtTV, the Fox News Channel, and MSNBC.  He has also appeared in The New York Times, The Washington Times and The Wall Street Journal.

Professor Smith is a graduate of the New York University School of Law.  He is also a Phi Beta Kappa graduate of the University of South Carolina with a degree in Economics, where he studied under Robert Clower, the former editor of the American Economic Review and a former Rhodes Scholar at Oxford.

Professor Smith served as a law clerk for the Honorable D. Brook Bartlett, a judge for the United States District Court for the Western District of Missouri.  Upon the completion of his clerkship, he joined the firm of Skadden, Arps, Slate, Meagher & Flom in New York City as an associate.  In 1998, he became associated with the firm of Kasowitz Benson Torres & Friedman LLP, and then later became an equity partner.  In 2007, he founded a boutique law firm in New York City, which handled complex litigation and provided legal, business and reputational advisory work to domestic and international clients
